Privacy Policy
Support Homecare Services LLC is committed to safeguarding the privacy and confidentiality of all Protected Health Information (PHI) as required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) (45 CFR Parts 160, 162, and 164), the HITECH Act (Pub. L. 111-5), Pennsylvania Human Services Act (62 P.S. § 101 et seq.), Pennsylvania Department of Health Home Care Regulations (28 Pa. Code Chapter 611), and Office of Long-Term Living (OLTL) requirements for HCBS waiver programs including Act 150, Community HealthChoices (CHC), and OBRA waivers. As a HIPAA-covered entity providing non-medical home care services, we maintain administrative, technical, and physical safeguards to protect PHI in any form—electronic, paper, or oral—from unauthorized use, disclosure, or breach.
Uses and Disclosures of PHI: We may use or disclose PHI for Treatment (coordinating care with physicians), Payment (billing Medicaid, private pay, or third-party payers), and Healthcare Operations (quality improvement, staff training) without authorization. Disclosures for public health reporting, abuse/neglect prevention, legal requirements, or to avert serious threats to health/safety comply with HIPAA minimum necessary standards. We obtain written authorization for psychotherapy notes, marketing, or sale of PHI, and provide an Accounting of Disclosures upon request (45 CFR § 164.528).
Individual Rights: Clients have the right to access, amend, restrict, or request confidential communications regarding their PHI (45 CFR § 164.524-526). We provide a Notice of Privacy Practices at first contact and upon request, detailing these rights. Our Privacy Officer Madhan Khanal (412-693-9030), oversees compliance and responds to complaints within 60 days. Safeguards and Security: Access to PHI is limited to authorized personnel on a need-to-know basis. Electronic PHI is secured with encryption, access controls, and audit logs per HIPAA Security Rule (45 CFR Part 164, Subpart C). We conduct annual security risk assessments, staff HIPAA training, and breach notification protocols.
Business Associates: Agreements with vendors (e.g., billing services) mandate equivalent HIPAA protections. Breaches are investigated promptly with mitigation measures.
